1. The short version
blindcat is a software service for running mushroom cultivation operations. By creating an account you agree to use it responsibly, keep your credentials safe, and accept that the service is still evolving. We agree to keep your data secure, be honest about what the product can do, and give you the data back if you leave.
The sections below say all of that in more careful language.
2. Who these terms are between
These Terms of Service ("Terms") are a contract between you (the "Customer" or "you") and blindcat LLC, a company registered in Tbilisi, Georgia ("blindcat", "we", "us"). They govern your access to and use of the websites at blindcat.app, cat.blindcat.app and any related services, APIs and software we provide (together, the "Service").
By creating an account or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.
3. The Service
blindcat provides a cloud-hosted platform for cultivation operations: lifecycle inventory, live environment sensor monitoring, yield analytics, multi-site management, calendar, finance and related features. The exact set of features available to your account depends on the plan you are on — see the pricing page.
The Service is delivered over the internet, on a subscription basis. We may add, change or retire features over time. We will give reasonable notice for any change that meaningfully reduces what your plan does for you.
4. Beta status & no SLA
The Service is currently in active beta. We do not yet commit to a formal uptime SLA, a guaranteed support response time, or feature backwards-compatibility windows. We try hard to keep everything up and healthy, but if you are running a mission-critical commercial operation, you should keep your own local backups and independent alerting until we exit beta and publish an SLA.
5. Your account
To use most of the Service you need an account. You agree to:
- Provide accurate information when you sign up
- Keep your password and any API tokens confidential
- Tell us promptly if you suspect unauthorised access at [email protected]
- Be at least 16 years old
- Not share your account with people who are not authorised users on your site
You are responsible for everything that happens under your account, including the actions of any users you invite into your site.
6. Acceptable use
You agree not to:
- Use the Service for anything illegal in your jurisdiction
- Cultivate, track or document any species or substance prohibited where you operate (see Section 7)
- Attempt to break, probe or overload the Service, or interfere with another customer's use of it
- Reverse-engineer, decompile or copy the Service beyond what applicable law expressly allows
- Resell, sublicense or white-label the Service without a written agreement with us
- Use the Service to send spam, phishing, malware or unlawful content
- Scrape, crawl or harvest data from the Service other than via the official API and within published rate limits
We may suspend or terminate an account that breaches this section, with or without prior notice depending on severity.
7. Lawful cultivation
blindcat is designed for cultivating edible and medicinal mushrooms that are legal in the customer's jurisdiction, as well as related agriculture. You are responsible for ensuring that what you grow, track, store and sell on the platform is lawful where you operate. Possession or cultivation of certain species is controlled or prohibited in many countries — we do not provide legal advice, and using the Service does not authorise you to do anything that local law forbids.
8. Plans, pricing and payment
Current plans and their limits are listed on the pricing page. The Free plan is available immediately on signup; no payment information is required. Paid plans (Hobby, Pro, Commercial) can be purchased in-app under Settings → Billing.
Payment is by cryptocurrency, processed by Cryptomus (hosted checkout; you pay in your chosen coin, prices are set in USD). Plans are prepaid per period — monthly, or annually at a 16% discount — and do not auto-renew: to stay on a paid plan, pay again before your current period ends. We send a reminder email before expiry; if a period lapses, the workspace falls back to the Free plan and your data is retained subject to the Free plan's limits.
Refunds: all payments are final. Cryptocurrency transactions cannot be reversed, so we do not offer refunds. The Free plan includes every core feature — please evaluate the Service before upgrading. If something goes wrong on our side (an outage, a billing error), contact [email protected] and we will extend your plan period as compensation instead.
Any change of payment provider will be announced in-app and by email at least 30 days in advance.
9. Your data
Everything you put into blindcat — inventory records, sensor data, notes, calendar entries, financial entries, site configuration — belongs to you ("Customer Data"). You grant us a limited, non-exclusive licence to host, store, process and display your Customer Data solely to provide and improve the Service for you.
You can export your data at any time from your account settings. We handle Customer Data in line with the Privacy Policy.
10. Confidentiality
Each party will protect the other's non-public information with the same care it uses for its own confidential information, and at least a reasonable standard of care. This obligation does not cover information that is or becomes public through no fault of the receiving party, was already lawfully held, or is required to be disclosed by law.
11. Suspension and termination
By you
You can delete your account at any time from account settings. After deletion you enter a 30-day grace window during which the account can be restored on request. After 30 days, your account and Customer Data are permanently erased from primary storage; backup snapshots roll off within an additional 60 days. Exporting your data before deletion is recommended.
By us
We may suspend or terminate your account if you materially breach these Terms, abuse the Service, fail to pay an invoice after a reasonable cure period, or if we reasonably believe continued operation would expose us or other customers to legal or security risk. We will tell you the reason where we can and, where appropriate, give you a chance to fix the issue first.
Sections of these Terms that by their nature should survive termination — including data ownership, liability, indemnity and governing law — will survive.
12. Warranties & disclaimer
We warrant that we will provide the Service with reasonable care and skill. Beyond that, and to the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind — express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.
blindcat is a tool. It is not a substitute for trained mycological judgement, food-safety controls or regulatory compliance. You remain responsible for what you grow, sell and certify.
13. Limitation of liability
To the maximum extent permitted by law:
- Neither party will be liable to the other for any indirect, incidental, consequential, special or exemplary damages — including lost profits, lost crops, business interruption or loss of goodwill — arising out of or related to these Terms or the Service.
- Our total aggregate liability arising out of or related to these Terms, regardless of cause of action, will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100).
Nothing in these Terms limits liability that cannot lawfully be limited — for example, liability for fraud, wilful misconduct, or death or personal injury caused by negligence.
14. Indemnity
You will defend and indemnify blindcat against third-party claims arising from (a) Customer Data, (b) your breach of these Terms or the law, or (c) your use of the Service in a way the Terms do not permit. We will tell you about the claim promptly and let you control the defence, provided you do not settle in a way that admits fault on our behalf without our consent.
15. Changes to the Service or these Terms
We may update these Terms over time. If a change is material — for example, a change to liability, payment, or how we handle your data — we will give at least 30 days' notice by email and by an in-app notice before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not, you can close your account before the change takes effect.
Non-material updates (typo fixes, clarifications, new vendors that do not change the privacy posture) take effect on posting.
16. Governing law and disputes
These Terms are governed by the laws of Georgia (country), without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts of Tbilisi, Georgia, for any dispute arising out of or related to these Terms or the Service — except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
If you are a consumer in the EU/UK, this clause does not deprive you of any mandatory rights to bring claims in your local courts.
17. Miscellaneous
- Entire agreement — these Terms, together with the Privacy Policy and any plan-specific terms, are the complete agreement between you and us about the Service.
- Severability — if any provision is held unenforceable, the rest stays in force.
- No waiver — failing to enforce a right is not a waiver of that right.
- Assignment — you may not assign these Terms without our consent. We may assign them to a successor in connection with a merger, acquisition or sale of assets.
- Force majeure — neither party is liable for delay or failure caused by events outside its reasonable control.
